Several legal scholars have recently argued that U.S. tort law’s physical-emotional distinction commits tort to the objectionable position of mind-body dualism, but they have not considered the distinction’s role as an aid to judicial cognition and decision-making. Drawing primarily on the law of negligent infliction of emotional distress, this essay argues that tort’s physical-emotional distinction is not a relic of mind-body dualism but a heuristic that judges have used to structure and simplify the difficult but unavoidable task of drawing lines (...) between legally cognizable and non-cognizable harm. The analysis has at least three normative implications: (1) users of tort’s physical-emotional distinction should clarify that they neither endorse dualism nor depreciate emotional harm; (2) because judicial expertise may not extend to the task of drawing lines between legally cognizable and non-cognizable harm, judicial performance in this area may be more adequate than critics suggest; and (3) although it may not be possible to determine the optimal way of drawing lines between legally cognizable and non-cognizable emotional harm, moral-philosophical tools such as Rawlsian and Scanlonian contractualism may be able to identify partial or pro tanto considerations for choosing among different ways of doing so. The aim of this study was to conduct a Scenic Narrative Microanalysis of a modern dance performance, “Kontakthof” by Pina Bausch, performed by lay dancers over 65 years of age. SNMA analysis consisted of both individual and group sessions with students of the International Psychoanalytic University. The method was successfully applied to artistic material insofar as relevant moments in terms of “Now Moments” and “Moments of Meeting” were identified by the raters throughout the dance piece. In this book we attempted to gather together a set of chapters that describe new ways of approaching questions about aesthetics and innovation. Rather than going over old ground, the chapters describe attempts to break out in new directions. The book begins with a description of von Ehrenfels development of a Gestalt theory of aesthetics so evocative of the Vienna of 1900 that readers will wish that they had been there to experience the intellectual excitement and ends with a survey (...) the very latest research on brain scan research on perception of art. In between, we encounter chapters as diverse as a description of cognitive effects on art perception and on the analogies between oscillations in art history and waves in the physical world. About half of the book contains chapters by well known western psychological aestheticians and half chapters by Russian scholars many of whom will be new to western readers. As well as describing new methods and results, the chapters by Russian scholars will be novel to most western readers, because the Russian perspective on aesthetics and innovation is rather different than the traditional western perspectives. Looking at phenomena from new viewpoints never hurts and very often helps in science. (shrink)

The highly homologous Rac1 and Rac2 GTPases are co‐expressed in cells of haematopoietic origin and are likely to show some functional redundancy. While disruption of the Rac2 gene in mice has provided insight into some of its functions, Rac1 null mice are embryonic lethal and only recently has conditional gene disruption been possible. Consequently, two articles1,2 have recently elucidated some overlapping and unique key roles of Rac1 and Rac2 in haematopoietic processes including specialized roles in innate and humoral immunity. We are demonstrating that the Luttinger model with short range interaction can be treated as a type of Fermi liquid. In line with the main dogma of Landau’s theory one can define a fermion excitation renormalized by interaction and show that in terms of these fermions any excited state of the system is described by free particles. The fermions are a mixture of renormalized right and left electrons. The electric charge and chirality of the Landau quasi-particle is discussed.

The paper questions some of the premises in studying academic spin-offs in developed countries, claiming that when taken as characteristics of ‘academic spin-offs per se,’ they are of little help in understanding the phenomenon in the Eastern European countries during the transitional and post-transitional periods after 1989. It argues for the necessity of adopting a path-dependent approach, which takes into consideration the institutional and organisational specificities of local economies and research systems and their evolution, which strongly influence the patterns of (...) spin-off activity. The paper provides new findings and original arguments in support of Balazs’ seminal theses (Balazs 1995, 1996) about the emergence of academic spin-offs during the early transition. It reveals key economic and policy mechanisms bearing on academic entrepreneurship in Eastern Europe, such as the tensions between economic and political nomenclatures of former Communist Parties, where the dismantling or preservation of the power of political nomenclature resulted in different patterns of development—rapid reforms in the ‘first wave’ of EU accession countries or the establishment of rent-seeking and assets-stripping economies in countries like Bulgaria and Romania, making the transition period especially difficult. In the latter, a specific economic environment emerged, unknown in Western Europe and in the ‘champions’ of transition—such as suppression of the authentic entrepreneurship in a number of economic sectors, disintegration of corporate structures, etc. Thus, the paper reveals the common ground behind the two conflicting tendencies in post-socialist academic spin-offs, partially outlined in other research (Simeonova 1995; Pavlova 2000): as an authentic form of academic entrepreneurship grasping the opportunities opened up by the economic crisis and compensating failures in science and technology policy on the one hand, and as specific rent-seeking strategy draining valuable public assets on the other (the latter, in turn, boosting the negative attitudes in local scientific communities). The paper provides new findings about the evolution of the academic spin-offs in Bulgaria along the two polar trends and their positive and negative repercussions on parent research institutions. This article examines the global and worsening problem of research misconduct as it relates to bio-medico-legal education. While research misconduct has serious legal implications, few adequate legal remedies exist to deal with it. With respect to teaching, research ethics education should be mandatory for biomedical students and physicians. Although teaching alone will not prevent misconduct, it promotes integrity, accountability, and responsibility in research. Policies and law enforcement should send a clear message that researchers should adhere to the highest standards of (...) ethics in research. It is vital that researchers and physicians understand basic aspects of law and the legal system in order to develop understanding of the medico-legal issues not just in the legal context, but with a sound grounding in ethics, social and theoretical contexts so that they can practice good medicine. Routine and holistic research ethics education across the curriculum for medical students and resident physicians, and continuing medical education for practicing doctors, are probably the best ways to accomplish this goal. While art and science still functioned side-by-side during the Renaissance, their methods and perspectives diverged during the nineteenth century, creating a still enduring separation between the "two cultures". Recently, artists and scientists again collaborate more frequently, as promoted most radically by the ArtScience movement. This approach aims at a true synthesis between the intuitive, imaginative methods of art and the rational, rule-governed methods of science. To prepare the grounds for a theoretical synthesis, this paper surveys the fundamental commonalities and differences (...) between science and art. Science and art are united in their creative investigation, where coherence, pattern or meaning play a vital role in the development of concepts, while relying on concrete representations to experiment with the resulting insights. On the other hand, according to the standard conception, science seeks an understanding that is universal, objective and unambiguous, while art focuses on unique, subjective and open-ended experiences. Both offer prospect and coherence, mystery and complexity, albeit with science preferring the former and art, the latter. The paper concludes with some examples of artscience works that combine all these aspects. (shrink)

The scientific novelty of the research consists in identifying and substantiating the interrelations in the process of social reproduction, which provides innovative educational and educational activities in a music college. As a result, the authors have developed a technology of social audit of the process of reproduction of the socio-cultural potential of youth in a music (...) college. The technologization of the process made it possible to develop a model for managing the reproductive processes of the socio-cultural potential of college youth based on the principles of a project-oriented approach. Artificial intelligence research connected with learning theory ("deep learning," “machine learning,” analysis of the quality of learning, etc.) has existed for many years; however, there have been few investigations in that area conducted from a robust philosophical methodological basis.

This book's critical approach addresses the anachronism, essentialism and ethnocentrism that underlie contemporary theoretical and methodological uses of the term «cosmopolitanism». It explores the concept of cosmopolitan reason from the viewpoints of comparative literature, psychoanalysis, phenomenology, postcolonialism and moral philosophy.

Combat sports and martial arts are often associated with aggressiveness among the general public, although data on judo and/or martial arts and aggressiveness seem to be unclear. This research aims to compare athletes who have trained judo for a prolonged time and athletes from various team sports, primarily regarding the manifestation of aggression, but also regarding personality traits, emotional intelligence, and self-efficacy. Also, the potential predictive value of personality traits, emotional intelligence, and self-efficacy for aggression within subsamples of judokas and (...) team athletes was tested. The research findings showed that professional judo athletes are characterized by a low degree of aggression, especially low indirect and physical manifestations of aggression. In addition, the personality traits Honesty-Humility and Openness to experience are well expressed, contrary to Emotionality and Extraversion, which are less pronounced. They are also characterized by moderate general self-efficacy. On the other hand, members of team sports produced the opposite results, as they are characterized by increased aggression, pronounced traits of Emotionality and Extraversion, somewhat less pronounced traits of Honesty-Humility, Openness to new experience, and less pronounced general self-efficacy. The percentage of explained variability of aggression is slightly higher in the subsample of team sports and constitutes 49.9% of the variability, while in the subsample of judokas it constitutes 47.8% of the variability of the criteria. Practical implications, limitations, and future research directions were discussed. (shrink)
